After a thorough review, the Jury of Appeals found and unanimously decided as follows: The Jury found that reports of course cutting were not definitive, and that such reports could not be sufficiently corroborated to positively identify the accused. The results will stand, and the decision is final. The Jury of Appeals expresses its thanks for the reports of course infractions that it did receive. The Jury regrets that its instructions weren’t clearer, thereby affording a timely submission of such reports, which would have helped in seeking corroborative support for the reported infraction. For future Ascent and Marathon races, guidelines for reporting course infractions will be posted prominently in registration materials. Course marshals will be increased to monitor as much of the upper course as possible. Clear distinctions will be drawn between cutting the course to reduce time, versus stepping off the trail, or going slightly off trail to avoid a collision.
